It’s 2026 – eighteen long years with no answers and no resolve for Lindsay Buziak and her family.

Let this be the year that Lindsay, her family and friends finally see the justice they so rightfully deserve. Let’s review this case, speaking only of the facts as we know them. No speculation, just the facts. Perhaps, when all the facts are laid out, things will become much clearer for all of us. One thing we know for certain. Lindsay was a young girl who loved life, loved her career and was looking forward to attending her friend’s birthday party that Saturday evening. She was not involved in any criminal activity and that was confirmed by the Saanich Police.

In the days leading up to her murder there were approximately 10 calls back & forth between Lindsay & the mystery woman caller. The calls originated from a burner phone in Vancouver, a burner phone which had been purchased from a Seven-Eleven convenience store. The Saanich Police have never disclosed where the burner phone was activated, though they have publicly stated the burner phone was activated & travelled to Victoria 24 hours prior to Lindsay’s murder.


November 2007

Lindsay is telling friends and family that she was planning on leaving Jason.


December 14/15/16th

Lindsay travels to Calgary to visit her dad. In an emotional state she tells him that she saw something she shouldn’t have seen but wouldn’t tell him what it was. However, she did tell him it was something she saw in Victoria. During their visit Lindsay expressed her concerns about leaving Jason, said she was just waiting for a few deals to be paid out. She was worried too, that if she did leave the Re/Max office that Shirley might withhold any monies that she had coming to her.


December 21/2007

After an evening out, Lindsay & her friend Nikki returned to Lindsay’s place. They sat in the living room chatting like girls do. Thinking that Jason was fast asleep Lindsay was telling Nikki that she was definitely planning on leaving Jason in the New Year. She was just waiting for a few deals to close so she’d have some extra money to work with. Then they heard a noise on the other side of the bedroom doorway and realized he had been listening to their conversation.

Fearing Jason’s reaction, Nikki jumped up, raced for the front door and left the condo. Lindsay raced after her. Jason tried to call Lindsay numerous times, but she did not answer. Jason then called his mother Shirley to tell her what had happened. (calls supported by phone records) Lindsay returned to the condo shortly after she had calmed Nikki down and dropped her off at her car downtown.

When Lindsay returned home Jason never once mentioned what had happened the evening before. It’s like it never happened. Over Christmas Jason gave Lindsay some very expensive jewelry/watch. Lindsay returned one of the articles as she was not comfortable with keeping such an expensive gift, especially since she was planning on ending the relationship. Not far into the New Year, she decided she was so ready to get out of the entanglement with the Zailos.

December 21/2007

On the 2010 Dateline show John Markiewicz said to Jason Zailo, “there are people out there that say Lindsay was getting ready to pull the plug and move on. Is there any truth to that?” Jason responded, “there is none, there is no truth to that”.


Dec 31st/Jan 1/Jan 2 2007/2008

Jason’s mother Shirley treated the family to an extravagant Xmas/New Years Whistler vacation in a top rated “suite” hotel. She had also invited the drug trafficker Ziggy Matheson to join them. Ziggy is the guy that lived in Shirley’s 2768 Claude Road property and had always been treated like a member of the family. Ziggy had been a tenant in Shirley’s rental property for years and his only source of income was from selling heroin, MDA, cocaine, ecstasy, date rape drug etc. He was a very close friend of Jason & Ryan, and the boys played in a hockey league together. Ziggy would drop by the Re/Max office and pay his rent to Shirley in cash, and after Lindsay’s death Ziggy was the one who helped Ryan clean Lindsay’s office out.

A CHEK News article from 2016 states that says Shirley denies knowing about Ziggy’s drug activity and says her family has no ties to Ziggy Matheson.


Shirley’s sister was/is a heroin addict who is currently living in Surrey. This is the sister who claims Shirley and her two nephews Ryan & Jason were involved in fraudulent real estate activity.

JANUARY 22/2008 Calgary Drug Bust – Operation High Noon

A major drug bust took place in Calgary. Two men were arrested, one of those men was Erickson Lopez Delalcazar, a member of a criminal family who lived in Victoria. Because Lindsay had visited her dad in Calgary December 2007, the Saanich Police were investigating as to whether there was any connection. It would be Jason Zailo who would lead them in that direction. At first the Saanich Police had led the public to believe that Lindsay had tried to contact Erickson when she was visiting her dad in Calgary.

They would later retract that statement saying it was actually a relative of Ericksons she was trying to reach. There is absolutely no evidence to show that Lindsay ever made contact with this guy or a relative. This didn’t stop the rumors from flying around, with lots of articles claiming Lindsay was a high school friend of Erickson Delalcazar.

This was false information and couldn’t have been farther from the truth. There was a 5-year age difference between Erickson & Lindsay, and they never even attended the same high school. Lindsay did meet up with an old friend when she visited Calgary, and his name was Mitch Hawthorn. He was a friend throughout grade school. Mitch had no connection to the Calgary Drug Bust.

It was Sgt. Chris Horsley who originally gave the press this incorrect information and never once have the Saanich Police come forward to apologize for their mistake. It is very possible that it is mistakes like this that took this investigation in the wrong direction. While so much time was wasted in Victoria, the real conspirators were right under our noses here in Victoria.


February 1/ 2008 – Friday Evening

Shirley claims that she stopped by Lindsay’s condo shortly after 7:00 pm and just happened to overhear Lindsay on the phone giving the client the address. Shirley also tells the police that her & Lindsay went for a long walk that evening, then had sushi at a local restaurant downtown. The Saanich Police have no restaurant receipt to support this claim, or any proof that Shirley was with Lindsay on that Friday evening. It is just Shirley’s word. That same evening, Shirley says Lindsay told her that she was afraid of her ex-boyfriend Matt.

The Saanich Police tell us that Lindsay was the one who chose the DeSousa house and gave the address to the client. However, their only source for this information came from Shirley who claims to have overheard Lindsay give the client the address on that Friday evening.

This revelation first came about when Shirley blurted this out on the Dateline Dreamhouse Mystery show which aired October 2010. Not one of Lindsay’s family or friends ever heard Lindsay say such a thing, and they did not believe a word of it.

At 6:40 pm, just prior to Shirley’s 7:15 pm arrival, Lindsay made a call to her dad. Lindsay and her dad spent about 15 minutes chatting and not once did Lindsay mention that her and Shirley had been out for a walk, were going for a walk, going out for dinner, or even that Shirley might be dropping by. (Lindsay’s call supported by phone records)


February 1/2008

Jason tells Zander Sherman, the Capital Daily News journalist that Lindsay was still awake around midnight when he returned home from playing hockey. As well, he reminded Buziak that she had received a similar call from a woman about a month earlier, and that the client’s $900,000 budget had been almost identical. But in that case, the mysterious call had ultimately yielded a sale. There’s no indication the two calls are connected, and Zailo appears to have brought it up only to reassure Buziak.

Fact is, Lindsay had no similar call or sale about a month earlier.


February 2/2008 2:00 pm

Lindsay arrives at the Re/Max Camosun office downtown. Lindsay asks the receptionist to cross-reference/google the client’s phone number to see if something might come up. The receptionist told the Saanich Police that “Lindsay seemed freaked out”. Lindsay was in the coffee area upstairs chatting with other realtors & expressing her concerns about the showing. Realtor Cal Faber offered to accompany Lindsay to the showing. Lindsay politely declined, telling Cal and the others that Jason was going to be there.

“She had full confidence in the fact that her boyfriend was going to be there,” Faber said. 


Jason tells Capital Daily journalist that Lindsay was not concerned about the showing. Zander Sherman says, Jason’s account here seems to differ from what Lindsay’s colleague Cal Faber told him which was that he and other colleagues were under the impression that Jason planned to accompany Lindsay to the showing prior to Lindsay stopping by the Re/Max Camosun office. 

In court documents obtained by Capital Daily it shows that Shirley told police she took a call from Lindsay at 2:00 pm. According to Shirley Lindsay was at the Chatterton branch of Re/max Camosun and had some questions unrelated to the clients or the meeting. 

Why then, did Sgt. Chris Horsley dismiss reports that Buziak was nervous to meet with the couple, saying she thought the showing was unusual because she was not the listing agent, but she wasn’t apprehensive about it?


Feb 2/2008 3:00 pm

At approximately 3:00 pm, Lindsay and Jason met for a late lunch at Sauce in downtown Victoria. The bill is time-stamped & shows that the bill was paid at 4:24 pm. Jason & Lindsay leave, he to go to SHC Autographx to present an offer, and Lindsay to go home to change. Surveillance cameras at the business above SHC show Jason leaving the parking lot at 5:30 pm, accompanied by his friend Cohen Oatman. The Saanich Police have never told us the time of Jason’s arrival time.

Jason tells journalist Zander Sherman: So, I had a client at SHC and Lindsay actually had a client buying their condo I went to SHC to present the new offer from Lindsay’s client.

As it turns out, Jason was not telling the truth. There was no offer that he & Lindsay were working on that evening.

Sgt. Chris Horsley told the press that Jason was going to the DeSousa house because he had real estate documents to sign. That was false information. Horsley later recanted that story, telling the press that Jason was going to the house because Lindsay was concerned and wanted him to be there.


February 2/2008 Leaving SHC 5:30 pm

Jason leaves SHC at 5:30 pm, the exact time he told Lindsay he would be at the house to meet her. Seemingly Jason is unable to bring up the address on his GPS, so does not know the directions how to get to the 1702 DeSousa property. This makes perfect sense as the house is on a new street that Google would not yet have in their system. However, the directions were in the comments on the MLS listing. On route Jason called his brother Ryan to ask for directions to the home, even though it was his mother who had previously been to the property.

Jason & Cohen arrive at the DeSousa home. Jason tells the police that as he turned into the cul-de-sac, he saw shadows through the frosted glass in the front door. Jason drives by the house and parks in the cul-de-sac facing away from the house only visible in the driver’s rear mirrors for 10 minutes. He then moves his vehicle out onto Torquay & parks in an old bus stop beside the house for another 10 minutes.

At 6:05 Jason & Cohen leave the vehicle and head to the front door. Jason knocks several times, but Lindsay does not answer. Finally, his friend Cohen spots an open patio French door. Jason lifts Cohen over the fence, then he heads back to wait for Cohen to open the front door.

When entering the house Jason ran straight up the stairs, only to find Lindsay lying in a pool of blood. On Dateline Jason told Josh Mackiewicz that he touched her skin and knew she had passed away. He would later tell police that he had given Lindsay CPR and that is how he became covered in Lindsay’s blood.


It is unclear what Jason really saw that night.

Jason told the police that he saw the male buyer but only from the back. He claims the man was wearing a two-tone classy brown jacket that hung just below the waist. Interesting, because the witness driving by gave a completely different description.

And here’s is what Sgt. Chris Horsley told the press.

“Jason actually saw the couple, a Caucasian man and a blonde woman wearing a colorful dress. The door was open, and the witnesses actually observed the male suspect exiting the house. The killers were actually about to walk out the front door and leave, and Jason turned into the cul-de-sac and interrupted them leaving. Jason’s assumption is these are the clients and the showing is just starting as the door closes. He then parks outside because he is waiting for the showing to end”.

Detective Chris Horsley also said, there were two independent witnesses that were able to describe the couple that greeted Lindsay in the driveway, but only one witness was able to describe the dress the woman was wearing. Was Jason that one witness that was able to describe the woman in the dress?


FEBRUARY 3/2008

Jason is released from the police station on the morning of February 3rd. That evening he calls his drug dealer friend Chris Schwartz and asks if he can come over to talk. Chris just happened to live in the same condo building as Jason & Lindsay. When Jason arrives him & Chris go out onto the patio where they spent 20 minutes talking in private. Chris is a drug dealer who Jason introduced to Ziggy Matheson a year earlier, because he wanted Chris to buy his drugs from his friend Ziggy, the drug trafficker. Both Chris & Ziggy had connections to the HA on the mainland.

When Jason was confronted by Garry R as to why he had gone up to Chris’s that night, he hesitated for a minute then said, oh yeh, Chris called me up and said he thought he might know who murdered Lindsay, and that I should come over. Jason’s story differs from what Chris Schwartz had to say. Chris claims that Jason called him at 10:00 pm that evening and asked to come over. He asked Chris, “do you think the boys from Van will be okay with me now? Boys from Van being the HA. (info supported by a letter)


FEBRUARY 6/2008

Zachary Matheson (Ziggy) makes a phone call to his good friend Steef de Frel (Steve). Ziggy is trying to arrange a meeting with some of his drug friends. The meeting is to figure out how to protect the Zailo’s from Vid Acevedo. Apparently, Vid was on the warpath and after the Zailos. It is unclear why. Steve did not want any part of this and told Ziggy he was not interested in attending. Supposedly Vid & his Delalcazar associates were furious when finding out what the Zailos had done. (This info supported by a letter)


During an interview with Capital Daily’s Zander Sherman

Shirley Zailo claimed her business had been affected by all the rumors about her family. She said, “you go to a listing and all they want to know is about Lindsay and then they don’t want your sign on their lawn. My business has gone way down over the years.”

It’s hard to imagine that Shirley’s business or Jason’s for that matter was affected after Lindsay’s murder.

In April 2007, Shirley purchased the #218 68 Songhees condo for just over $450K. For whatever reason she registered the condo in her son Ryan’s name. That was the condo that Jason & Lindsay moved into. Prior to Lindsay moving into the condo, Shirley spent over 70K on refurbishing/ furnishing the condo. Shirley also owned the homes at 2772 & 2768 Claude Road in Langford. 2768 is the property that Ziggy Matheson lived in.

A month later she bought the 1965 Pillow Road luxury waterfront property in Shawnigan Lake for 1.3 million and spent over $200K on renovations and furnishings.

In October of that same year she bought #1 7088 West Saanich Road, a commercial Brentwood Bay property for just over$300K. Paid cash. This purchase was so her boyfriend Paul Bergshoeff & his business partner Joe DeSousa, owner of the murder house, could operate a new coffee shop on the premises. (JJ’s coffee house) October 2020 – Shirley purchases 78836 Daffodil Court Palm Dessert $390K US.


2013, Shirley took the ferry over to the mainland, to pick up another new vehicle.

She paid “cash” $137,500 for a 2010 Porsche Turbo Carrera which she bought at the Porsche Dealership in Vancouver. Jason was driving an Audi R8 at the time valued at approximately $150K. These are just a few of the many high-priced vehicles the Zailos have owned over the years.


2017 SGT. CHRIS HORSLEY FLIES TO CALGARY ACCOMPANIED BY ANOTHER SAANICH OFFICER

He arrives unannounced at Jeff Buziak’s real estate office and begins to threaten him with ultimatums, including telling him to shut his blog down or else. When Lindsay’s dad asked the other police officer to identify himself, the officer refused. Horsley told the cop not to say who he was. Chris Horsley, millionaire real estate developer, financier, nightclub owner and owner of Discount Dumping & media supporter of the Zailo family.

On the Dateline show Sgt. Chris Horsley stated, Jason’s last text to Lindsay was at 5:38 pm when he texted her to say, “I’m on my way”.  That text was never opened. Why is it that Jason Zailo says differently? Josh Markiewicz said that after 10 minutes of Jason being parked on Torquay Jason got a feeling something was wrong and texted, “are you okay and I didn’t get a text back, that really worried me.”  That would have put Jason’s last text to Lindsay at shortly after 5:55 pm?


2021 CAPITAL DAILY NEWS JOURNALIST ZANDER SHERMAN

went out of his way to create a story titled “what that the internet got wrong” and throughout the article disparaged Lindsay’s dad Jeff. Shirey Zailo, Lindsay’s mom Evelyn Reitmayer, a friend of Shirley Zailo’s and the whistle blower Sandra Bryant all fed Zander enough garbage that he believed he had a best seller. Ms. Bryant turned out to have no credibility whatsoever.

When the smoke cleared, it turned out that much of what the Capital Daily wrote about him turned out to be false inuendo.
